Drawoid — Terms of Service

Welcome to Drawoid. These Terms of Use ("Terms") govern your access to and use of the Drawoid application ("App"), including its AI-assisted drawing features, provided by PaletteX.AI Inc. ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using Drawoid, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Account Registration, Guest Mode, and Authentication

2.1. You may use the App's local drawing, video, and 3D editors without an account ("guest mode"). To generate AI content or make purchases, you must create an account using either Sign in with Apple or Sign in with Google. Work created in guest mode is stored only on your device; when you first sign in, your local guest work is associated with your account on that device.

2.2. You are responsible for maintaining the security of your Apple ID or Google account credentials.

2.3. You must provide accurate and complete information through your chosen authentication method.

2.4. You must be at least 18 years old to create an account.

2.5. You may delete your account at any time through the App settings. Upon deletion:

• Your account information will be permanently deleted from our servers.
• Any unused credits ("paint coins") will be forfeited.
• If you choose to register again in the future, you will start with 0 credits.
• Your locally stored artwork will remain on your device unless manually deleted.

3. License and App Usage

3.1. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

3.2. You may not:

• Modify, reverse engineer, or create derivative works of the App.
• Use the App for any illegal purpose.
• Attempt to gain unauthorized access to the App or its systems.
• License, sell, or lease any part of the App.
• Copy or distribute the App in any way not expressly permitted by these Terms.

4. AI Features and Content Generation

4.1. The App includes AI-assisted rendering and generation features that help create and modify artwork, including generated images, video clips, and 3D models.

4.2. AI processing occurs on our servers and on the servers of third-party AI model providers (models hosted on Replicate, including models from providers such as ByteDance, Google, and OpenAI), but all output media — images, videos, and 3D models — are stored locally on your device.

4.3. You retain ownership of the content you create using the App.

4.4. We do not sync your files or media across devices; all artwork remains solely on the device where it was created.

4.5. AI-generated content requires the use of credits ("paint coins"), which can be purchased through the App as coin packs or obtained through a subscription plan.

4.6. We do not guarantee the uniqueness or originality of AI-generated content.

4.7. You are responsible for ensuring any content you create or modify complies with applicable laws and regulations.

5. User Content

5.1. You retain ownership of the content you create, upload, or share through the App ("User Content").

5.2. By uploading User Content for AI processing, you grant us a temporary, limited license to process your content on our servers and through our third-party AI model providers for the sole purpose of providing AI-assisted rendering and generation services.

5.3. You represent that you have all necessary rights to your User Content and that it does not infringe on any third-party rights.

6. Privacy and Data Collection

6.1. Our collection and use of personal information is governed by our Privacy Policy.

6.2. We may collect usage data to improve the App and its features.

6.3. You consent to the collection and use of data as described in our Privacy Policy.

7. In-App Purchases

7.1. The App offers in-app purchases of credits ("paint coins") and optional auto-renewing subscription plans that enable AI generation features.

7.2. All payments, including subscriptions, are processed through the Apple App Store and subject to Apple's terms. Subscriptions are managed, and can be cancelled, in your App Store account settings.

7.3. Credits are consumable items that are depleted when used for AI generation.

7.4. Unused credits are non-transferable and will be forfeited upon account deletion.

7.5. Refunds are handled according to Apple's refund policy.

7.6. We reserve the right to modify the pricing and quantity of credits available for purchase.

8. Intellectual Property Rights

8.1. The App, including its code, design, and features, is protected by copyright and other intellectual property rights.

8.2. All trademarks, logos, and service marks displayed in the App are our property or the property of their respective owners.

9. Disclaimer of Warranties

9.1. THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

9.2. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9.3. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10. Limitation of Liability

10.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10.2. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR CREDITS IN THE APP IN THE PAST 12 MONTHS.

11. Termination

11.1. We may terminate or suspend your access to the App at any time for violations of these Terms.

11.2. You may terminate your use of the App at any time by deleting your account and/or removing the App from your device.

11.3. Upon termination, sections 5, 8, 9, and 10 will survive.

12. Changes to Terms

12.1. We may modify these Terms at any time by posting updated Terms in the App.

12.2. Your continued use of the App after changes constitutes acceptance of the modified Terms.
